On 8 May 2014, the Italian Privacy Authority have made known a set of regulations to identify simplified methods for the policy and for the acquisition of consent for the use of cookies; this document was transposed into law by the State, Cookie Law, on 3 June 2014 (also see the Privacy Authority, no to profiling cookies without consent).
With this law, the website owner/administrator is obliged to acquire the informed prior consent of users for the installation of cookies used for purposes other than strictly technical.
What are cookies?
Cookies are text files containing minimum amounts of information sent to the browser and stored on the user’s computer, telephone or other device, every time that a website is visited. At each connection the cookies send information to the website of reference.
Cookies can be permanent (persistent cookies) if they remain on the computer until the user deletes them, or they can be temporary (session cookies) if they are deactivated when the browser is closed. Cookies can also be first-party cookies if set by the visited website, or third-party cookies if inserted by a website other than the one being visited.
For the purposes of law, the Privacy Authority identifies two types of cookie: “technical cookies” and “profiling cookies”.
Technical cookies
Technical cookies are the ones used for the sole purpose of “transmitting communication on an electronic communication network, or to the extent strictly necessary to the supplier of a service of the information company explicitly requested by the subscriber or user to provide this service” (see Art. 122, subsection 1, of the Privacy Code).
They are not used for further purposes and are normally installed directly by the owner or administrator of the website. They can be divided into navigation or session cookies, which guarantee normal navigation and use of a website (allowing, for example, purchases to be made or authentication for accessing reserved areas); any analytics cookies, assimilated into technical cookies (where directly used by the website administrator to collect information, in aggregate form, on the number of users and on the way in which they visit the website itself; functionality cookies that allow users to navigate according to a series of selected criteria (for example, language, products selected for purchasing) in order to improve the service provided to same. Prior consent of the user is not required for the installation of these cookies.
Profiling cookies
Profiling cookies are used to create user profiles and are used to send advertising messages in line with the preferences shown by same when navigating on line. Due to the particularly invasive nature of these devices within the user’s privacy, European and Italian laws require the user to be suitably informed as to the use of same and to express their valid consent. This is referenced in Art. 122 OF THE Privacy Code, which states that “the storage of information in the terminal of a contractor or a user, or access to information already stored is permitted solely on the condition that the contractor or user has expressed their consent, after being informed with the simplified method as per Article 13, Privacy Code, subsection 3”.

Google Analytics

Other third-party cookies
